Are there any risks with Illinois Powers of Attorney?

The main risk associated with Illinois Powers of Attorney relates to your selection of the person (your Agent) you want to handle your affairs if you are unable to do so.  If you name an individual who is unsophisticated in financial or health care matters, is untrustworthy, or otherwise a bad choice as your Agent, very real harm could be done to you and/or your estate.  Thus, it is absolutely critical to consider the character and experience of the person you are naming as your Agent for Powers of Attorney.  Some factors to consider in naming an Agent would be:

  • The named Agent’s core values and beliefs
  • The named Agent’s trustworthiness and integrity
  • The named Agent’s knowledge and experience
  • The named Agent’s availability to serve as your Agent

Choosing the right person as your Agent is an incredibly important decision, and it is advisable to take some time to give the necessary thought and attention to choosing the best person for you.
